1. About these terms

This website at www.brief.case (the Site) is operated by Briefcase Technology Pty Ltd (Briefcase, we, us or our). These terms of use (Terms) govern your access to and use of the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you should not use the Site.

2. The Site is information only

The content of the Site is provided for general information about Briefcase and our products. It does not constitute legal, professional or other advice, and it is not a substitute for advice tailored to your circumstances. Nothing on the Site creates a solicitor-client, adviser or fiduciary relationship between you and Briefcase.

While we take care to keep the Site accurate and current, we make no representation that the content is complete, accurate or up to date at any given time.

3. Access to the Briefcase platform

The Site describes, but does not itself provide, the Briefcase case management platform. Access to the platform is governed by separate written agreements between Briefcase and the relevant institution, including terms dealing with data handling, security, service levels and fees. If there is any inconsistency between these Terms and a platform agreement, the platform agreement prevails in respect of the platform.

4. Acceptable use

You must not use the Site in a way that is unlawful, that interferes with its operation or security, that attempts to gain unauthorised access to any system or data, or that imposes an unreasonable load on our infrastructure. You must not scrape, harvest or systematically extract content or data from the Site without our prior written consent.

5. Intellectual property

The Site and its content, including text, graphics, logos, product names, page designs and software, are owned by or licensed to Briefcase and are protected by intellectual property laws. Briefcase, the briefcase wordmark and HallucinationCheck are trade marks of Briefcase Technology Pty Ltd.

You may view, download and print content from the Site for your personal or internal business purposes, provided you keep all proprietary notices intact. You must not otherwise reproduce, modify, distribute or commercialise Site content without our prior written consent.

6. Third-party links and services

The Site links to and embeds services operated by third parties, including our meeting scheduler and social media pages. Those services are governed by their own terms and privacy policies, which we encourage you to read. We are not responsible for the content or practices of third-party services.

7. Disclaimers and liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other statute that cannot lawfully be excluded, restricted or modified.

Subject to the paragraph above, the Site is provided on an 'as is' and 'as available' basis, and we exclude all other warranties, whether express or implied. To the maximum extent permitted by law, Briefcase is not liable for any loss or damage (including indirect or consequential loss, or loss of data, profit or opportunity) arising out of or in connection with your use of, or inability to use, the Site.

Where our liability cannot be excluded but can be limited, it is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.

8. Privacy

Our collection and handling of personal information in connection with the Site is described in our Privacy Policy, which forms part of these Terms.

9. Changes

We may update these Terms from time to time by publishing a revised version on the Site. The revised Terms take effect when published. Your continued use of the Site after publication constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Briefcase submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.
